1. Acceptance of Terms
By accessing, browsing, registering for, or executing operations through the ATELIER // ARCH computing platform, workstation interfaces, or programmable application programming interfaces (collectively, the "Service"), you confirm that you have read, comprehended, and unconditionally agree to be bound by these Terms of Service (the "Terms").
This agreement constitutes an enforceable contract between you ("User", "Operator", or "You") and Atelier Computational Systems Ltd ("ATELIER // ARCH", "Company", "We", or "Us"). If you are accessing this Service on behalf of a corporation, partnership, or enterprise entity, you warrant that you possess the explicit corporate authority to legally bind such entity to these Terms.
2. The Service Continuum
ATELIER // ARCH provides a unified computational generative environment designed to collapse conceptual latency across three primary operational domains:
High-fidelity spatial design, architectural concept rendering, structural visual schemas, and layout synthesis.
Cohesive omnichannel editorial asset suites, typographic grids, seasonal launch collateral, and multi-format variants.
Photometric packshots, calibrated studio illumination matrices, 360° rotational turntables, and virtual manufacturing proofs.
These capabilities operate within a single continuous creative pipeline. ATELIER // ARCH reserves the right to iteratively augment, calibrate, deprecate, or modify underlying algorithmic pipelines, inference nodes, and model weights to maintain institutional-grade computational output.
3. Account Registration
Access to computational features requires establishing a validated Operator Account. Accounts are configured on a personal solo-operator or designated enterprise seat basis. You affirm that:
- All registration details, payment records, and jurisdictional credentials provided are strictly accurate, current, and verifiable.
- You are solely accountable for sustaining the strict confidentiality of your cryptographic authentication tokens, passkeys, and API credentials.
- You will immediately notify ATELIER // ARCH Security of any unauthorized session breach, leaked token, or credential invalidation.
- Credential sharing, multi-user concurrency on single-seat allocations, and unauthorized credential farming are strictly prohibited.
4. Credits & Payments
The ATELIER // ARCH runtime functions via internal creative processing units ("Credits"). Credits quantify computational cycles, GPU tensor hours, diffusion sampling, and high-resolution rendering passes across our infrastructure.
- •Supported Fiat Currencies: USD ($), EUR (€), and GBP (£) processed via licensed PCI-DSS Level 1 payment gateways.
- •Minimum Transaction Floor: Minimum top-up amount is strictly fixed at 10.00 units in the respective billing currency.
- •No Artificial Maximum: Creative allocations scale unconstrained according to enterprise requirements.
- •Fiat Settlement Only: All balances settle strictly in lawful fiat tenders. No cryptocurrencies, speculative tokens, or decentralized virtual assets are accepted.
- •Receipts & Records: Complete electronic invoices and transaction manifests remain accessible in your billing console. Refund inquiries are governed exclusively by our published Refund Policy.
5. Creative Content (Input vs Output)
Our architecture draws a categorical distinction between assets uploaded by the user and synthetic media generated by the inference engine:
5.1 User Input: Includes text prompts, vector guides, reference images, color profiles, CAD meshes, and 3D volumes provided by the Operator. You represent and warrant that you hold all title, licenses, permissions, and rights necessary to introduce such input material into the Service without violating third-party rights.
5.2 Generated Output: Encompasses the high-resolution renders, video loops, depth maps, vector layouts, and photometric assets returned by the algorithmic pipeline. To the extent permitted by applicable law, ATELIER // ARCH assigns to you any ownership rights it may hold in the Generated Output resulting from your licensed prompt interactions.
6. Intellectual Property
Except for User Input, all intellectual property in the Service—including proprietary shader pipelines, node compilation software, UI designs, brand marks, and model architecture—remains the exclusive property of Atelier Computational Systems Ltd.
Because generative AI legal frameworks continue to evolve across global jurisdictions, ATELIER // ARCH makes no affirmative legal representations regarding the copyrightability or registerability of Generated Output under specific territorial trademark or copyright offices. Operators bear sole responsibility for conducting clearance searches prior to major commercial brand exploitation.
7. Acceptable Use
You agree not to misuse, exploit, or disrupt the Service. Prohibited operations include, but are not limited to:
• Generating content that is unlawful, harmful, threatening, abusive, defamatory, or invasive of individual privacy.
• Bypassing compute limits, reverse-engineering weights, decompiling client packages, or scraping platform memory buffers.
• Using automated spiders or unthrottled headless scripts outside of certified REST/WebSocket endpoints.
• Creating non-consensual biometric representations, deceptive deepfakes, or misleading commercial impersonations.
Detailed enforcement matrices are documented within the separate Acceptable Use Policy.
8. Third-Party Materials
The Service may incorporate integrations, model adapters, font foundries, or compute infrastructure managed by sovereign third parties. ATELIER // ARCH does not endorse, assume liability for, or control independent external tools or data links. Your engagement with external assets is governed solely by the applicable third party's contractual stipulations.
9. Privacy Protocol
The processing, retention, and encryption of personal identities, telemetry signals, and raw inputs are strictly executed according to the ATELIER // ARCH Privacy Architecture. We do not use customer inputs or proprietary enterprise outputs to train global foundation models without explicit opt-in consent.
10. Service Availability
While ATELIER // ARCH targets continuous operational uptime across global clusters, we do not guarantee uninterrupted platform latency. Routine maintenance cycles, inference hardware reconfigurations, or systemic communications provider outages may occur. Real-time platform status is continuously tracked on our public system register.
11. Disclaimers
Generative synthesis is non-deterministic. Operators must review, verify, and validate all generated visual media, typography, and photometrics before commercial publication.
12. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Atelier Computational Systems Ltd, its directors, computational engineers, or suppliers be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data corruption, or business interruption.
13. Indemnification
You agree to defend, indemnify, and hold harmless ATELIER // ARCH and its affiliates against any third-party claims, liabilities, damages, judgments, or costs (including reasonable legal fees) arising from your User Input, your breach of these Terms, or your commercial deployment of Generated Output in violation of applicable laws.
14. Suspension & Termination
We reserve the right to suspend or terminate your workstation access immediately, without prior notice or liability, in the event of documented material breach, unauthorized runtime reverse-engineering, payment default, or compliance directives issued by governing authorities.
Upon account termination, your right to initialize new generative nodes ceases immediately. Unused creative credits shall be subject to the terms detailed in the Refund Policy.
15. Changes to Terms
ATELIER // ARCH reserves the right to amend these Terms as technology, jurisdictional regulations, and computational pipelines evolve. Material adjustments will be signaled via console banner notifications or email dispatches at least fourteen (14) calendar days prior to their effective date. Continued execution of prompt operations after revisions become active constitutes acceptance.
16. Governing Law
These Terms, their interpretation, and any disputes arising directly or indirectly from your platform usage shall be governed by the laws of [GOVERNING LAW / JURISDICTION TO BE INSERTED: E.G., THE STATE OF DELAWARE, UNITED STATES], without giving effect to conflicts of law principles.
NOTE: FOR ENTERPRISE JURISDICTIONAL ADAPTATIONS, PLEASE CONTACT ENTERPRISE LEGAL RELATIONS DIRECTLY.
